This first application has been filed by applicant under Section 439 of the Code of Criminal Procedure, 1973 for grant of bail in connection with Crime No.22 of 2024 registered at Police Station Bhitarwar, District Gwalior (M.P.) for offence punishable under Sections 376 and 450 of IPC. The applicant is in judicial custody since 16.01.2024. A s per the case of prosecution, prosecutrix aged around 35 years submitted a written complaint to SHO, PS- Bhitarwar on 14.01.2024 that previous day i.e. 13.01.2024, her husband and son had gone out for some work. Her mother-in-law had gone to local market and her daughters were working in the agricultural field. She was alone sitting in front of her house. An unknown person came and asked about her husband. When she went inside the house, that unknown person entered her house and committed rape on her.

Thereafter, the person fled away. Hearing her shout, her neighbour came to her house. She narrated the incident. Some unknown person was calling from mobile number (***) on her mobile number (***) and making indecent proposals. She called her husband and informed about the incident. On such allegation, PS- Bhitarwar registered FIR
