ORDER

Heard on the question of admission and interim relief.

In this petition under Article 226 of the Constitution of India, the petitioners have prayed for the following reliefs :

'' सहायता -

1) यह है िक पुलस अधीक जला रतलाम को यह आदेिशत िकया जावे िक वह स्तुत आवेदन एनेक् श्चर पी- 8 पर जॉंच कर दोषी व्यिय के िव करण दजर् करे व जॉंच के तथ्य से यािचकाकतागण को अवगत करवाये ◌ा

2) यह है िक त्याथगण्◌ा मांक 3,4,5 एवं 6 का यह आदेत िकया जावे िक वह मेसस िशवांश इन्टराईजेस क पूव ोपरयटर -ीमित शांितदेवी क बीमा पॉलसी कट करते हए समस्त बक राश्ि◌ संबधत बीमा कं पनी के माध्यम से जमा करवावे तथा यािचकाकतागण से िकसी भी कार क ऋण संबंधी वसूली नह करे एवं बंधक संप के कब्जा क कायवाही को समाप्त करवाते हए कब्जा ाप्त नह करे एवं ीमित शांितदेवी क मृत्यु उपरांत बक ऋ म यािचकाकता ारा जमा क गई समस्त राशी यािचकाकतागण को वापस कर◌ा

3) यह है िक अपर कलेक् टर जला रतलाम एवं तहसीलदार शहर रतलाम को यह आदेिशत िकया जावे िक वह बंधक संपित 52, ाहम्मण का वास रतलाम भवन कु ल ेफल 2115.38 के कब्जे संबंधी समस्त कायवाही को िनरस्त करे व उक् त संप का कब्जा ए.यू. स्माल फायनस कं पनी लिमटेड को नह सपेा

4) यह है िक अन्य सहायता जो माननीय न्यायालय उिचत समझे वह भी यािचकाकता को दत्त करवायी जावेा '' 2 . Brief facts of the case are that Smt Shanti Devi, proprietor of petitioner firm M/s Shivansh Enterprises has availed loan facility from the respondent no. 3 & 4/bank to the tune of Rs. 90,68,000/- for 15 years which was approved on 11.02.2017. A life insurance policy was also taken for the said loan from Bajaj Life Insurance Old Co. for security purposes. Smt. Shanti Devi died on 05.03.2017. After her death, respondent no. 3 & 4/ bank in connivance with Bajaj Life Insurance Co. Ltd. have changed the Life Insurance Policy and the said policy was not provided to the petitioners and instead another life insurance policy dated 16.06.2022 of Bajaj Allianz Life Insurance Comp. Ltd. was sent which was in the name of petitioner no.3 and not in the name of Late Smt Shanti Devi. Petitioners sought documents, however the respondent/bank has provided a declaration of good health cum membership form on which forged signature of petitioner no.3 were affixed. Petitioners have reported the matter to the police, however, no action has been taken. The property situated at 52, Brhamano Ka Waas Ward No. 39, Ratlam having an area of 2115.36 sq ft was mortgaged[referred to as mortgaged property] while availing the loan and therefore proceedings under the Securitization and Reconstruction of Financial Assets and Enforcement of Security Interest Act, 2002[referred to as "SARFAESI Act" hereinafter] were initiated by the respondent/bank. The Additional Collector, Distt Ratlam vide order dated 17.07.2023 had directed the petitioners to deposit the remaining amount of loan within a period of two months failing which the Tehsildar will provide the vacant possession of mortgaged property to the respondent/bank. Petitioners have approached the DRT, Jabalapur against the order dated 17.07.2023 and the application filed by the petitioners was registered as S.A. No. 833/2023 in which proceedings are going on. The Tehsildar has issued notice dated 20.02.2024 to handover the vacant possession of the mortgaged property by 06.03.2024. Hence, the present petition is filed.

Learned counsel for the petitioner submitted respondent/bank in connivance with the respondent/insurance company taking advantage of technicalities have prepared forged insurance policy in the name of petitioner no.3 in place of Late Smt Shanti Devi in whose name, the loan was sanctioned. In fact, the balance amount of loan has to be deposited out of the life insurance policy taken against the loan for security purposes. However, respondent/bank had started proceedings under the SARFAESI Act for obtaining the possession of mortgaged property on the one hand despite taking an amount of Rs. 70,68,181/- towards the loan. Hence, the Superintendent of Police, Ratlam be directed to take action
