This first application has been filed by applicant under Section 439 of the Code of Criminal Procedure, 1973 for grant of bail in connection with Crime No. 17/2024 registered at Police Station Behat, District Gwalior (M.P.) for offence punishable under Sections 392, 394, 398, 427 and 34 of the IPC and Section 11/13 of the MPDVPK Act. The applicant is in judicial custody since 13-05-2024.

As per the case of prosecution, Devendra Gurjar reported to SHO, PS Behat District Gwalior that on 18/02/2024 around 8.30 in the evening, he was going to Khamrauli Budera mines on his Hiva Dumper. He stopped the vehicle seeing a cow near Sharadi well. Harendra Gurjar came to window of dumper and snatched his mobile phone. Harendra Gurjar slapped him and took out Rupees Twenty Thousand from his pocket. Harendera Gurjar called his associate- Ramswaroop (applicant). Ramswaroop climbed up the dumper and took out Rupees Twenty Thousand from pocket of Lavkush on gun point.

Nanu Gurjar took out Rupees Five Thousand from other pocket of Lavkush.
