ORDER
By the present appeal filed under Section 374(2) of the Code of Criminal Procedure, the appellant has challenged the judgment of conviction and order of sentence passed by Special Judge ( Prevention of Atrocities) Act Seoni in Special Case No. 13/2002 whereby the appellant has been convicted under Sections 189 of Indian Penal Code and sentenced to undergo for 1 year and u/S 3(1)(x) of SC/ST( Prevention of Atrocities) Act and sentence to undergo RI for six months and fine of Rs. 200/- with default stipulations. 2. As none appeared on behalf of the appellant, Shri K.N. Fakhruddin Advocate who is present in the Court, has been requested to assist the Court on behalf of the appellant as amicus curiae.
3. The facts necessary for disposal of the present appeal in brief are that on 08.08.2001 at about 4:00 P.M., the appellant assaulted the complainant and abused him by making remark of her caste and given her threat to cause injury while she was performing her public duty.
