This petition coming on for admission this day, the court passed the

following:

ORDER

Learned counsel for the petitioner seeks withdrawal of this petition filed

under Section 226 of the Constitution of India with liberty to file an application

challenging the advertisement dated 31/5/2023 issued by Respondent No.3

whereby applications had been invited by the proposed committees to appoint

the managing committee for Waqf Dargah Hajrat Meer Badshah, Gwalior, of

which the Petitioner is claiming to be Mutawalli, before the Waqf Tribunal,

where dispute with regard to appointment of a managing committee to deal with

the affairs of the aforesaid wakf, in the 2019, is pending.

Since similar controversy is already pending before the Wakf Tribunal,

the prayer made appears to be reasonable, thus, if the petitioner files such an

application, the same be decided by the Tribunal as expeditiously as possible

preferably within 15 days thereof from the date of filing of the application.

With the above, the petition is disposed of.
