This first bail application has been filed by applicant under Section 439 of the Code of Criminal Procedure, 1973 for grant of bail in connection with Crime No.585 of 2023 registered at Police Station G.R.P (BG), District Gwalior (M.P.) for offence punishable under Sections 392 of IPC and 11/13 of MPDVPK Act. The applicant is in judicial custody since 29-08-2023. As per the case of prosecution, Ajay Narayan Khemria reported to PS GRP (BG), Gwalior that on 20.08.2023, to the effect that on previous day i.e. 19.08.2023, he was travelling from Aithar to Gwalior by passenger train. As the train reached Birla Nagar Railway Station, one unknown person had snatched his mobile phone and de-boarded the train. His Xiomi Note 10 Mobile Phone was looted. On such allegations, Police Station GRP (BG) registered FIR at Crime No.585 of 2023 for offence punishable under Sections 392 of IPC and 11,13 of MPDVPK Act. During investigation, applicant Boby Kushwah was arrested on 29.08.2023. He is in custody ever since. Complainant could not identify applicant Boby in Test Identification Parade.
