[2]. For convenience, the appellant is referred as 'defendant' while the respondents are referred as 'plaintiffs' as per their respective status in civil suit.
[3]. The plaintiff no.2 Ganesh Kumar Sharma and one Dakhobai purchased the property, which also includes the suit premises, from its earlier owner vide sale deed, dated 06.10.1998. Later on, Smt. The suit was filed under the provisions of M.P. Accommodation Control Act, 1961. The defendant filed his written statement and denied plaintiffs' title over the property. It is his submission that once the suit has been filed under the provisions of M.P. Accommodation Control Act, 1961, the plaintiffs cannot be allowed to seek relief of possession based upon their title. He further submitted that the remand directed by the learned Appellate Court is in excess of its jurisdiction under Order 41 Rule 23-A of CPC. The learned counsel also argued that the plaintiff cannot be allowed to raise alternate plea which are mutually destructive to each other. He also ar
