This petition coming on for admission this day, the court passed the following:

ORDER

Petitioner has filed this petition under Article 226 of the Constitution of India, making a limited prayer that Assistant Registrar be directed to consider his representation which is a complaint against Swami Narayandas Shiksha Samiti.

2. As per Section 32(2) of M.P. Society Registrikaran Adhiniyam, 1973, procedure has been prescribed how complaint can be filed and if complaint is filed in accordance with said procedure only then application can be entertained. As per Section 32(2) of the Adhiniyam, enquiry of the nature referred to in Section 32(1) can be entertained by Assistant Registrar only in case where majority of members of governing body of the society or not less than one-third of the total number of members of the society files an application.

3. Petitioner has not filed list of members of society so that court can determine whether one-third members or majority of members have filed this complaint.

4. In view of same, writ petition is dismissed (VISHAL DHAGAT)
