.....RESPONDENTS (BY SHRI ATAURREHMAN ANSARI- ADVOCATE FOR RESPONDENT NO.1)
This petition coming on for admission this day, the court passed the following:
ORDER
This review application under Section 47 read with Section 1 of CPC has been filed for review of order dated 27.06.2023 passed by this Court in W.P. No.6136/2014 on the ground that applicant had appeared for the first time before the High Court therefore, he could not understand the proceedings of the Court and some incorrect statements were made.
Considered the submissions made by counsel for applicant.
On 27.06.2023, applicant had made a specific statement that the record was misplaced in the Office of Commissioner, Rewa and therefore, it could not be produced. When this Court called an explanation from Commissioner, Rewa Signature Not Verified Signed by: PRIYANKA in the form of an affidavit by pointing out the issues, then applicant immediately took a summer salt and started claiming that he had made a false statement thereby putting blame on the Court of Commissioner. Thus, it was clear that although applicant was afraid of Commissioner, but he was not afraid of the Court proceedings.
Be that whatever it may be. Making a false statement before the Court amounts to contempt of Court and this Court by not drawing the contempt proceedings has already shown mercy towards applicant.
As no error apparent on face of record could be pointed out by counsel for applicant, accordingly no case is made out warranting interference.
Review petition fails and is hereby dismissed (G.S. AHLUWALIA)
