HIGH COURT OF MADHYA PRADESH
Satish Sondhiya – Appellant
Versus
The State Of Madhya Pradesh – Respondent
MCRC 14748/2025

Advocates:
Amit Kumar Dwivedi,Advocate General

IN THE HIGH COURT OF MADHYA PRADESH AT JABALPUR BEFORE HON'BLE SHRI JUSTICE MANINDER S. BHATTI ON THE 2nd OF MAY, 2025 MISC. CRIMINAL CASE No. 14748 of 2025 SATISH SONDHIYA Versus THE STATE OF MADHYA PRADESH Appearance:

Shri Himanshu Tiwari - Advocate for applicant.

Smt. Priyanka Mishra - Govt. Advocate for State.

ORDER This is the first bail application filed by the applicant under Section 483 of the Bhartiya Nagrik Suraksha Sanhita, 2023 for grant of regular bail relating to FIR/Crime No.879/2024 dated 06.12.2024 registered at Police Station Kolar Road, District Bhopal for the offences punishable under Sections 115(2), 140(2), 296, 351(2) and 3(5) of the Bhartiya Nyay Sanhita, 2023. The earlier bail application was dismissed as withdrawn vide order dated 04-03-2025 with liberty to revive the prayer after examination of material witnesses.

2. The counsel for the applicant contends that in the present case the co-accused Brajmohan has been enlarged on bail by this Court vide order passed in M.Cr.C. No.4349/2025, dated 24-02-2025 and another co-accused persons, namely, Bhagwan Singh Sondhiya and Arun Sen have also been enlarged on bail by the trial Court, the said order has Signature Not Verified Signed by: AJAY KUMAR been brought on record along with I.A. No.10183/2025. It is thus contended by the counsel that the case of the present applicant stands on identical footing and he be also enlarged on bail.

4. The counsel for the State has opposed the application and submitted that the present applicant was instrumental and kidnapped the victim. Thus, the counsel submits that no case for grant of bail is made out.

5. Having considered the submissions, perusal of the record reflects that the statement of Hemraj Parte recorded under Section 161 CrPC, dated 8-05-2024 reflects that when the abductee was made to sit in the Swift car, the co-accused Brajmohan, the present applicant and Ghanshyam Lodhi got down and later on other co-accused persons, namely, Golu Purwaiya, Samandar Gurjar, Rahul Gurjar, Ravi Sondhiya and Arun Sen took the abductee to the road adjoining to Village.

6. Thus, considering the aforesaid, the case of the present applicant appears to be identical with the co-accused Brajmohan, who has already been enlarged on bail by this court. Thus, this Court deems it proper to release the applicant on bail. Without expressing any view on the merits of the case, this application is allowed.

7. It is directed that applicant namely Satish Sondhiya shall be released on bail on furnishing a personal bond in a sum of Rs.50,000/- (Rupees Fifty Thousand Only) with one surety in the like amount to the satisfaction of the trial Court concerned for his appearance before the Signature Not Verified Signed by: AJAY KUMAR said Court on all such dates as may be fixed in this regard during the pendency of trial.

8. It is further directed that the applicant shall comply with the provisions of Section 480(3) of the Bhartiya Nagrik Suraksha Sanhita, 2023.
