HIGH COURT OF MADHYA PRADESH
Vishal Mishra, J
Ravikant Mishra – Appellant
Versus
The State of Madhya Pradesh – Respondent
Writ Petition No. 17466 of 2025

Advocates:
For the Appellants/Petitioners: Shri Rajesh Kumar Tiwari
For the Respondents: Shri Prabhanshu Shukla

Dependents of classified daily rated employees can be considered for compassionate appointment despite previous regularization issues.

Headnote:This matter involves a writ petition under Article 226 of the Constitution, seeking to quash an impugned order and direct compassionate appointment based on prior circulars. The court finds that there is no barrier under the policy to consider applications for compassionate appointments of dependents of employees classified as 'Sthai karmi.' The ratio decidendi includes the interpretation that classification under applicable circulars permits such appointments. Consequently, the court quashes the earlier order and remits the matter back for reconsideration.
