ORDER

Parties agreed that this matter may be disposed of in terms of order Signature Not Verified Signed by: RAJESH KUMAR passed in W.P. No.28040/2021. This Court in the said order recorded as under:-

"Learned counsel for the parties have given consent to follow the order passed in W.P.No.19139 of 2023 (Laxmi Narayan Dixit vs. State of M.P. and others)

The said order reads as under :- "With the consent, finally heard.

During the course of hearing, learned counsel for the parties submit that this petition may be disposed of in terms of recent Full Bench decision in W.P. No.4118 of 2020 (Ratanlal Rathore vs. State of M.P. and others wherein the Full Bench has followed the dicta of Supreme Court in SLP (C) No.8219 of 2020 (Madhya Pradesh Power Transmission Company Limited and another vs. S.R. Ramchandran & others)

In view of consensus arrived at, this petition is disposed of directing that the decision of Ratanlal Rathore will mutatis mutandis apply to the petitioner with full force. The respondents are directed to act in accordance with the direction contained therein.

Petition is disposed of."

The present Writ Petition is disposed of in terms of said order. The aforesaid order will apply mutatis mutandis in this case with full force."

In view of consensus arrived at, petition is disposed of by holding that order passed in the aforesaid Writ Petition will apply mutatis mutandis to this case with full force.
