ORDER This criminal appeal under Section 376 of Criminal Procedure Code , 1973, is preferred challenging the conviction under Section 376 of Indian Penal Code , 1860 and sentenced to seven years RI with fine of Rs.1000/- with further default stipulation of six months RI vide judgment dated 11.06.2002 in Sessions Case No.164/2001 by Additional Sessions Judge, Biaora, District-Rajgarh (MP).

02. The facts of the case in nutshell is that the appellant/accused has been convicted for committing rape with a woman (PW/7) on 26.08.2001 at about 10:00 am. It is stated that when the prosecutrix/victim was cutting the grass in agricultural field with cattles, regarding which an offence was registered on 26.08.2001 as Crime No.121/2001 at Police-Station-Suthaliya, District-Rajgarh (MP), on charges framed under Section 376 of IPC.
