HIGH COURT OF MADHYA PRADESH
GAJENDRA SINGH, J
CHILD IN CONFLICT WITH LAW THROUG SARPARAST – Appellant
Versus
THE STATE OF MADHYA PRADESH – Respondent
CRIMINAL REVISION No. 2485 of 2025

Advocates:
For the Appellants/Petitioners: Shri Abhishek Rathore
For the Respondents: Shri Hemant Sharma

A child's best interests must be considered based on social investigation reports when deciding on supurdgi under the Juvenile Justice Act, preventing undue harm to their development.

Headnote:This criminal revision under section 102 of the Juvenile Justice Act, 2015, challenges the denial of supurdgi to a child in conflict with law based on potential harm to his health, following rejection by the Juvenile Justice Board and Special Judge. The courts below neglected the social investigation report which indicated the child's background was consistent with rehabilitation. The main issues were adherence to section 12 of the Juvenile Justice Act and considerations of the child's social conditions. The court held that the rejection was not in line with the social investigation report, allowing for the child's supurdgi under supervision. The revision succeeds, and the earlier orders are set aside, with specific conditions for the child's care outlined.
