JUDGMENT

This first appeal, under Section 96 of the CPC, has been filed against the judgment and decree dated 2.01.2001 passed by Additional District Judge, Sheopurkalan in Civil Suit No. 5B/1997.

2. The original plaintiff has expired during the pendency of this appeal and the appeal is being prosecuted by her legal representatives.

3. Facts necessary for disposal of present appeal, in short, are that plaintiff filed a suit pleading inter alia that she is the owner and in possession of Survey No. 302, area 4 Bigha 15 Biswa, Survey No. 304, area 28 Bigha 10 Signature Not Verified Signed by: ANAND Biswa, total area 33 Bigha 5 Biswa situated at Village Nagdi. The order of temporary injunction is in force against the defendants. In Samvat 2047 (year 1990), plaintiff had sown mustard crop which was stolen by defendants in February,
