1] This petition has been filed by the petitioner under Section 528 of the BNSS for modification of order dated 3/7/2025 passed in MCRC.No.24006/2025. In the aforesaid order dated 3/7/2025 this Court has rejected the second anticipatory bail application of the present petitioner.

2] Counsel for the petitioner has submitted that in para 6 of the aforesaid order this Court has observed that the Civil Suit No.44/2024 was not filed by the complainant as contended by the applicant but by one Mansaram with whom the main accused Signature Not Verified Signed by: REENA PARTHO persons had earlier entered into an agreeement for sale.

3] Counsel for the petitioner has submitted that the aforesaid civil suit no.44/2024 was contested between the complainant and co- accused persons of crime No.62/2025. Copy of the Civil Suit No.44/2024 has also been filed on record in which the complainant Azmal happens to be the plaintiff, whereas the co-accused Mahendra is the defendant.

4] Counsel for the petitioner has submitted that the applicant wants to surrender before the trial Court; however, the aforesaid finding may be taken against him while considering his regular bail application.
