ORDER The petitioner is a retired Supervisor of Women and Child Development Department. He retired on 30.06.2021. Challenge is made to recovery order Annexure P/1 whereby an amount of Rs. 1,59,017/- has been ordered to be recovered from the petitioner upon his retirement as an amount of erroneous payment made to the petitioner as a result of wrong fixation.

Recovery is for the period from 01.01.2006 to 01.04.2021.

2. The respondents have defended the recovery on the ground that the petitioner had submitted undertaking on 24.09.2018.

3. Upon consideration of the documents placed on record and arguments of respondents, it is evident that the petitioner that he is a retired class-III employee and no fraud, suppression or mis-representation is pleaded against the petitioner. The erroneous payment was made from 01.01.2006 onwards whereas the undertaking has been taken sometime i
