The present Writ Appeal u/S. 2(1) of the M.P. Uchcha Nyayalaya (Khand Nyay Pith ko Appeal) Adhiniyam, 2005 is arising out of the judgment dated 1/11/2018 passed by the learned Single Judge in Writ Petition No.7853/2016 (Aarya Maansingh Vs. State of MP & ors.,).

Facts of the case reveal that respondent No.10 Aarya Maansingh, before this Court has filed a Writ Petition under Article 226 of the Constitution of India, being aggrieved by the order dated 18/11/2016 passed by the Tribunal (SDO) allowing the election petition preferred by the present appellant namely; Ramprasad. Ramprasad by the same order has been declared as elected to the post of Sarpanch, Gram Panchayat, Piplyasent, Janpad Panchayat Nalkheda. Facts of the case reveal that the present appellant as well as respondent No.10 have contested the election in respect of the Sarpanch and the polling took place on 22/2/2015.
