ORDER In pursuance to the letter addressed to the Registrar General dated

29/09/2025, as per directions issued by the Division Bench of this Court in the case of In reference (suo moto) vs State of M.P. : Writ Petition No. 5184 of 2025 decided on 20.02.2025, cognizance was taken and the letter was treated as suo moto petition. Accordingly, this writ petition came up for consideration before this Court.

2 . The facts of the case, in substance, are that the prosecutrix is minor aged around 15 years. It is alleged that she was sexually assaulted and raped by accused, upon which, an FIR as Crime No. 514 of 2025 at Police Station Ramnagar, District Satna for the offences under Sections 332(b), 65(1), 64(2)(m), 351(3), 3(5) of BNS, Section 5(L)/6 of POCSO Act and under Section 3(2)(v) of SC/ST Act has been registered. During medical examination, the victim was found to be pregnant.

3. Vide order dated 08/10/2025, the State counsel was directed to procure latest medical report/ opinion from the Medical Board regarding termination of Signature Not Verified Signed by: SHUBHANKAR pregnancy of the victim.

4. Learned Government Advocate has filed a report of Medical Board dated

08/10/2025, relevant whereof reads as under:-

XX उ(cid:9) 15 वष (cid:12) 08 माह िनवासी जक(cid:20)रा टोला, (cid:3)हनौती थाना रामनगर को को सहायक उप िनर(cid:29)(cid:30)क (cid:31)ीमती कौश(cid:33)या देवी, थाना अमरपाटन (cid:37)जला मैहर (cid:39)ारा उसके (cid:7)पता के साथ आज (cid:3)दनांक 08.10.2025 को सायं 5.15 बजे मे(cid:3)डकल ट(cid:29)म के सम(cid:30) उप(cid:37)(cid:44)थत कराया गया, (cid:37)जसम(cid:45) पी(cid:3)डता क(cid:20) जांच क(cid:20) गई। नाबािलग पी(cid:3)ड़ता का वजन 38 (cid:3)क(cid:49)ा ऊँ चाई 145 सेमी है। जांच म(cid:45) पाया गया (cid:3)क नाबािलग पी(cid:3)ड़ता का 35 स(cid:52)ाह 6 (cid:3)दवस सोनो(cid:49)ाफ(cid:20) के अनुसार तथा पेट क(cid:20) जांच करने पर 36 ह(cid:55)ते का गभ (cid:12) पाया गया। Longitudinal, Cephalic, Presentation पाया गया। गभ(cid:44)(cid:12) थ िशशु क(cid:20) धड़कन सामा(cid:58)य 138 (cid:59)ितिमनट पाई गई। पी(cid:3)ड़ता को वतम(cid:12) ान म(cid:45) (cid:59)सव पीड़ा नह(cid:29) है तथा (cid:60)लीिनकली पी(cid:3)ड़ता क(cid:20) जांच करने पर खून क(cid:20) कमी होना पाया गया तथा (cid:3)दनांक 27.09.2025 क(cid:20) सी.बी.सी. र(cid:64)जांच (cid:65)रपोट(cid:12) म(cid:45) ह(cid:29)मो(cid:66)लो(cid:7)वन 7.3 (cid:49)ाम तथा (cid:67)लेटलेट 84000 पाये गये, जो (cid:3)क सामा(cid:58)य से कम है। पी(cid:3)ड़ता क(cid:20) गभाव(cid:12) (cid:44)था 36 ह(cid:55)ते होने के कारण िच(cid:3)क(cid:69)सक(cid:20)य गभप(cid:12) ात कराना उिचत नह(cid:29) होगा (cid:60)य(cid:70)(cid:3)क गभप(cid:12) ात हेतु द(cid:29) जाने वाली दवाईय(cid:70) से पी(cid:3)ड़ता तथा पी(cid:3)ड़ता के गभ (cid:12) म(cid:45) पल रहे िशशु के (cid:44)वा(cid:44)(cid:71)य पर बुरा असर पड़ सकता है। इसिलये (cid:59)सव क(cid:20) संभा(cid:7)वत ितिथ पर ह(cid:29) (cid:59)सव कराना उिचत होगा। पी(cid:3)ड़ता का ह(cid:29)मो(cid:66)लो(cid:7)वन और (cid:67)लेटलेट कम होने के कारण उसका (cid:59)सव हायर मे(cid:3)डकल से(cid:58)टर जैसे शासक(cid:20)य िच(cid:3)क(cid:69)सा महा(cid:7)व(cid:74)ालय र(cid:29)वा म(cid:45) जहां पर आ(cid:75)(cid:44)(cid:76)े(cid:3)टक आई.सी.यू. क(cid:20) सु(cid:7)वधा है, कराना उिचत होगा। आ(cid:75)(cid:44)(cid:76)े(cid:3)टक आई.सी.यू. क(cid:20) सु(cid:7)वधा

A report dated 09/10/2025 prepared by the Child Welfare Committee after counselling of victim as well as her father is also filed, wherein the statements of victim as well as her father have also been recorded, wherein they have categorically stated that they will continue with the pregnancy and want to deliver the child as this is danger to the life of the victim as the fetus is of more than
