MADHYA PRADESH HIGH COURT
, J
Deetu Damar and Another v. State of M. P.
Sessions Trial No.05/2017
For the Appellants/Petitioners: Shri Vivek Singh
For the Respondents: Shri Siddharth Jain
The Court reduced the sentence based on the appellants' lack of prior offenses and the nature of the incident.
Headnote:This appeal arises from the conviction under S.304 Part - II read with S.34 of the Indian Penal Code, 1860, involving an incident where the appellants assaulted the deceased over a petty issue related to money. The Court finds that the injuries sustained were not sufficient to cause death and that the appellants deserve leniency due to their background and time served. Key issues include the assessment of culpability and appropriateness of sentencing. The Court modifies the sentence from 07 years to the duration already served with an adjustment of fines.
