MADHYA PRADESH HIGH COURT
Gurpal Singh Ahluwalia, J.
Gwalior Land Deals And Finance Registered Partnership Firrm Through Partner Ashok Kumar Goyal v. Indra
Writ Petition No.168A/2014

The court emphasized the necessity for reconsideration of secondary evidence in light of previously submitted receipts, asserting the importance of ensuring all relevant documents are addressed.

Headnote:This writ petition under Article 227 of the Constitution of India seeks the setting aside of the trial court's order dated 11/11/2021, which denied the petitioner's application to exhibit secondary evidence of a partnership deed. The trial court dismissed the application based on the absence of documents proving submission of the original deed to the Income Tax Department, as referenced in Section 65 of the Evidence Act. The High Court found that relevant receipts were initially submitted, warranting a reconsideration of the application. The case is remanded for fresh consideration without prejudice to its merits.
