ORDER This first application has been filed by applicants under Section 483 of the Bharatiya Nagarik Suraksha Sanhita 2023 for grant of regular bail in connection with Crime No.83/2024 registered at Police Station Kotwali District-Ujjain(M.P.) for offence punishable under Sections 307, 392, 452, 147, 148, 149, 427, 323,294 and 506 of IPC. The applicants are in judicial custody since 24.11.2025.

Heard the arguments.

Perused the grounds for grant of bail stated in the application, case diary and the relevant material on record.

Learned counsel for the applicants, in addition to the grounds mentioned in the application, submits that the applicants are falsely implicated in the alleged offence. There was no intention to cause any serious injury. There was a dispute between members and office bearers of Mali Samaj Society, Ujjain with the complainant Lokesh Verma with regard to unauthorized occupation of a room in the Society Building. Applicant - Deepak and Manoj went to invite Lokesh Verma for the meeting. But Lokesh Verma and his associate manhandled them. They lodged a report against Lokesh Verma which was registered at Crime No. 82/2024 at the P.S. Kotwali, Distt. Ujjain on 02.05.2024 at 19:45 hrs. Thereafter, present prosecution was lodged against the applicants. Relevant seizures have been made from the applicants. The injured had suffered superficial injuries. Further custodial interrogation of the applicants is not needed in the matter. Further investigation and trial would take time to conclude. Jail incarceration is causing hardship to the applicants and their dependent family. Applicants are ready to cooperate in further investigation/trial.

Per contra, learned counsel for the State ably assisted by learned counsel for the objector opposes the application on the ground of gravity of alleged offence. However, after going through the case diary, he fairly states that no criminal antecedent is reported against the applicants.

Learned counsel for the objector contends that applicants and his associates have entered his office and assaulted him and his associates. A mobile phone, gold chain and Rs. 4,000/- were snatched in the incident, which are yet to be recovered. His office was ransacked by the assailants.

According to the material available on case diary, Lokesh Verma reported to Head Constable, Ravinda Kumar Kasde of P.S. Kotwali on 20.05.2024 that on the same day around 8:00 in the evening, he was working in the office. Jagdish Patel, Lochan Mali, Dwarkadheesh, Sanni alias Deepak (applicants no. 1) and Piyush alias Chintu (applicants no. 2) and others entered his office with intention to kill him and assaulted him. His Son Jayant tried to intervene. Piyush alias Chintu(applicant no. 2) assaulted Jayant with knife on his nose. One of his asscoiate Abhishek also came to his rescue. Jagdish snatched the mobile of Abhishek. Dwarkadheesh snatched his gold chain and Piyush alias Chintu took out Rs. 4000/- from his office drawer. All the accused had ransacked the office and damaged his computers and furniture. Accused were threatening to kill them. On such allegations, the P.S. Kotwali registered FIR for offence punishable u/Ss 307, 392, 452, 147, 148, 149, 427, 323, 294 and 506 of IPC against Jagdish, Lochan Mali, Dwarkadheesh, Sanni alias Deepak and Piyush alias Chintu and other offenders.
