ORDER This criminal revision under section 102 of the of the Juvenile Justice (Care and Protection of Children), Act, 2015 (for short 'the JJ Act, 2015' ) is preferred challenging the order dated 06.11.2025 in Criminal Appeal th no.192/2025 (Annexure-P/2) by the Children Court/ 6 Additional Sessions Judge, Ujjain (M.P.) arising out of order dated 17.10.2025 by Principal Magistrate, JJ Board, Ujjain, whereby the application under section 12 of the JJ Act, 2015 in connection with crime no.146/2025 registered at P.S.- Maakdon District Ujjain (M.P.) under section 103(1) of the BNS, 2023 and sections 25 and 27 of the Arms Act, 1959 has been rejected on the ground that the child will expose to the known criminals and the case is under investigation.
2. Facts of the case in brief are that revision petitioner was 17 years and 10 months old and on the date of incident i.e. 12.04.2025. Allegations are that revision petitioner was married in childhood and he caused stab injury to the deceased due to anger as the deceased has ill eye towards the wife of the revision petitioner. Deceased succumbs to injuries and crime no.146/2025 was registered at P.S. Makadon, District Ujjain. Revision petitioner was apprehended on 13.04.2025 and Principal Magistrate J.J. Board, Ujjain rejected the application under section 12 of the JJ Act, 2015 on the ground that allegations against the revision petitioner is heinous in nature and there is possibility that child in conflict with law will flee from the court of justice and will frustrate the end of justice. Further it was observed that it is in the interest of child in conflict with law that application be rejected.
3. The order was challenged through section 101 of the JJ Act, 2015 and the appellate court has affirmed the order of the Principal Magistrate JJ Board and recorded the finding that revision petitioner is exposed to moral and psychological danger and if he is released on bail then there is further possibility of exposed to physical and psychological danger. He further recorded the finding that there is possibility that witnesses will be adversely affected and end of justice will be frustrated.
4. Challenging the finding of Principal Magistrate JJ Board and Children Court this criminal revision is preferred for verification of the findings of Principal Magistrate JJ Board, Ujjain and Children Court, Ujjain and a report of social investigation report was collected and social investigation report discloses that there is no prior exposure of the revision petitioner to the criminal activities and the finding of the social investigation report is disclosed below:-

बालक एक साधारण प(cid:31)रवार का बालक है। उसके एक बड़(cid:28) बहन है, एक छोटा भाई है। प(cid:31)र(cid:32)(cid:33)थितज(cid:38)य कारण(cid:9) से बालक पर यह tiकरण हुआ tiतीत होता है। बालक 6 माह से तराना जेल म(cid:11) था। बालक खेत पर प(cid:31)रवार के साथ रहता है आस-पड़ोस म(cid:11) कोई मकान नह(cid:28)ं है। गांव के लोग(cid:9) ने बालक के (cid:17)वषय म(cid:11) अ(cid:17)tiय नह(cid:28)ं बोला है बालक को उिचत परामश(cid:22) के साथ एक अवसर (cid:44)दये जाने
