This first application has been filed by applicant under Section 483 of Bharatiya Nagarik Suraksha Sanhita 2023 for grant of regular bail in connection with Crime No.371/2025 registered at Police Station- Ringnod, District Ratlam (M.P.) for offence punishable under Sections 107, 127(2), 115(2) and 3(5) of the BNS, 2023. Applicant is in judicial custody since

07.10.2025.

Heard the arguments.

Perused the grounds for grant of bail stated in the application, case diary and the relevant material on record.

Learned counsel for the applicant, in addition to the grounds mentioned in the application, submits that the applicant is falsely implicated in the alleged offence. No offence, as alleged, is made out against the applicant. The intention to cause death of Rudra on part of applicant cannot be inferred. Allegedly, Rudra was caught with the sister of the applicant against the social norms. Rudra was handed over to his family members. Next day, he committed suicide. There was no instigation to commit suicide by the applicant. The final report has been submitted on completion of investigation. The applicant is aged around 20 years and is a mother of a suckling child. There is no likelihood of tampering with the evidence by the applicant for the reason that she is not capable to influence the witnesses. The trial would take time to conclude. Jail incarceration on false allegation is causing hardship to the applicant and her family members. Applicant is ready to cooperate in the trial.

Per contra, learned counsel for the State opposes the application on the ground of gravity of alleged offence. However, after going through the case diary, he fairly states that no criminal antecedent is reported against the applicant.

Learned counsel for the objector submits that Rudra was manhandled by the applicant and her associates and he was photographed. Rudra was distressed due to manhandling and ill-treatment of the applicant, therefore, he committed suicide next day. The complicity of the applicant is made out.

Therefore, the applicant may not be extended benefit of bail.

According to the material available on case diary, Rudra S/o Shyamlal Chouhan aged around 15 years hanged himself in the afternoon of

26.09.2025 at his home in Bachchda Dera Parvaliya. During inquest, dead- body of Rudra was forwarded for postmortem examination. The medical officer reported that Rudra had died due to asphyxia caused by ligature hanging. No other injury was reported in the postmortem report. It was revealed during inquest that Rudra and his friends went to meet a girl at Bachchda Dedra on 25.09.2025. The relatives of the girl, Anurag, Chirag, Neha(applicant), Harsh @ Lucky and Sumit caught Rudra with the girl. They harassed and manhandled Rudra and took his photographs. Later, Rudra was handed over to his family members. Rudra was distressed and feared social disrepute, therefore, he committed suicide. On such allegations, the P.S. Ringnod, District Ratlam registered FIR for offence punishable under Sections 107, 127(2), 115(2) and 3(5) of the BNS, 2023 against applicant Neha and six others. The applicant was arrested on 07.10.2025. She is in custody ever since. The final report has been submitted on completion of investigation. There is no direct allegation that applicant Neha intended death of Rudra or she had deliberately instigated Rudra to commit suicide. The veracity of the prosecution, intention and conduct of the applicant will be determined after evidence in the trial.
