JUDGEMENT Per: Justice Vishal Dhagat Appellant has preferred this appeal under Section 28 of Hindu Marriage Act read with Section 96 of C.P.C challenging part of judgement and decree dated 14.05.2024 passed in RCSHM No.96/2022, whereby trial Court has declined the prayer of appellant to return her property.

2. Counsel appearing for appellant pointed out paragraph-23 of the judgement. It is submitted by him that in said paragraph, trial Court has given reasoning as to why property is not returned. Trial Court found that Exhibit-P/3 are articles, which were presented in marriage. However, it was held that both parties have right over the property since same was gift property and, therefore, no order could be passed to return the same. Counsel appearing for appellant submitted that trial Court has committed an error of law.
