ORDER Petitioner is aggrieved by the order dated 17/7/2019 (Annexure P/2), passed by Chief Conservator of Forest, Shivpuri Circle, Shivpuri, whereby, the punishment of dismissal from service has been imposed upon him on account of misconduct found proved in departmental enquiry. He has also challenged the order dated 18/12/2020 (Annexure P/1), passed by Principal Chief Conservator of Forest, M.P., Bhopal, whereby, the appeal filed against the punishment order has been dismissed.

2. Facts necessary for decision of this case are that the petitioner initially worked as Daily Wager Draftsman in the Office of Director, Madhav National Park, Shivpuri during the period of 1983 to 1989. He was then appointed on the post of Draftsman in the respondent/department in the Office of Divisional Forest Officer, Shivpuri.

3. One Dharmendra Kumar Sharma lodged a complaint with regard to appointment of petitioner on the post of Draftsman on the ground of incorrect date of birth entered in his service book. He also approached this Court by filing W.P. No.5005/2015 seeking a writ of quo warranto. Since the respondents had already initiated departmental enquiry against the petitioner, the petition was disposed of vide order dated 23/10/2018 (Annexure P/3).

4. A charge-sheet was issued to the petitioner by Chief Conservator of Forest vide memo dated 6/10/2016. Following charges were levelled against him:

"आरोप कमांक-01 (cid:9)ी चं(cid:12)कांत िनगम मानिच(cid:17)कार (cid:18)दनांक 06.08.94 से वतम(cid:23) ान तक वनम(cid:24)डल िशवपुर(cid:29) कायाल(cid:23) य म(cid:31) पद(cid:32)थ है। इस अविध म(cid:31) इनके सेवापु(cid:40)(cid:32)तका म(cid:31) अं(cid:18)कत ज(cid:42)मितिथ (cid:18)दनांक 21.07.1967 (cid:17)ु(cid:18)ट पूण(cid:23) होने क(cid:46) िशकायत (cid:47)ा(cid:48) होने पर (cid:9)ी िनगम से हायर सेके(cid:24)(cid:49)(cid:29) पर(cid:29)(cid:50)ा क(cid:46) अंकसूची (cid:47)(cid:32)तुत करने हेतु लेख (cid:18)कया गया। (cid:9)ी िनगम (cid:52)ारा (cid:18)दनांक 12.02.2016 को (cid:47)(cid:32)तुत हायर सेके(cid:24)(cid:49)(cid:29) पर(cid:29)(cid:50)ा क(cid:46) अंकसूची म(cid:31) (cid:9)ी िनगम क(cid:46) ज(cid:42)मितिथ 21.07.1961 अं(cid:18)कत है। (cid:9)ी िनगम (cid:52)ारा सेवापु(cid:40)(cid:32)तका बनाये जाने के समय सेवापु(cid:40)(cid:32)तका पर अंगूठा एवं उगिलय(cid:57) के िनशान अं(cid:18)कत (cid:18)कये गये है पर(cid:42)तु (cid:9)ी िनगम, मानिच(cid:17)कार (cid:52)ारा अपनी सेवापु(cid:40)(cid:32)तका म(cid:31) ज(cid:42)मितिथ सह(cid:29) कराये जाने के संबंध म(cid:31) जानबूझकर कोई आवेदन (cid:47)(cid:32)तुत नह(cid:29)ं (cid:18)कया गया।

इस (cid:47)कार शासक(cid:46)य सेवको के आचरण िनयम(cid:57) के (cid:60)व(cid:61)(cid:62) कदाचरण कर म०(cid:47)० िस(cid:60)वल सेवा (वग(cid:64)करण िनयं(cid:17)ण तथा अपील) िनयम 1966 के

(cid:47)ावधान(cid:57) के तहत अपने आपको द(cid:24)ड का भागीदार बनाया गया है।

आरोप कमांक-02 (cid:9)ी चंदकांत िनगम, मानिच(cid:17)कार (cid:52)ारा वष(cid:23) 1983, 1984, 1985, 1986 एवं 1987 म(cid:31) माधव रा(cid:67)ीय उ(cid:68)ान कायाल(cid:23) य िशवपुर(cid:29) म(cid:31) दैिनक वेतन (cid:9)िमक के (cid:61)प म(cid:31) मानिच(cid:17)कार का काय(cid:23) (cid:18)कया गया एवं वष(cid:23) 1986 म(cid:31) आई.ट(cid:29).आई. िशवपुर(cid:29) से सवय(cid:70) र (cid:71)यवसाय म(cid:31) (cid:47)िश(cid:50)ण भी (cid:47)ा(cid:48) (cid:18)कया गया। अतः (cid:9)ी िनगम, (cid:52)ारा (cid:60)वभाग को धोके म(cid:31) रखते हुये एक ह(cid:29) समय म(cid:31) दो जगह काय(cid:23) (cid:18)कया गया है, जो संभव नह(cid:29)ं है।
