O R D E R This instant petition has been preferred by the petitioner under Article 226 of the Constitution of India, challenging the impugned order dated 05.06.2025 (Annexure-P/5) by which the candidature of the petitioner for the post of Mining Inspector has been rejected on the ground that the petitioner has not submitted the requisite documents within the stipulated time limit i.e. till 24.12.2024 not within the extended date with late fee i.e. 08.01.2025.

2. The facts of the case in nutshell is that the petitioner is holding the degree of Bachelor of Science from Devi Ahilyabai Vishwavidhyalaya, Indore (MP). It is stated that in response to an advertisement dated 27.09.2023 for the post of Mining Inspector, the petitioner applied and participated in the written examination and duly passed the same and the results of the written examination were declared on 03.12.2024. Thereafter, the petitioner was required to submit the documents for the document verification on 24.12.2024 which was further extended till 08.01.2025 with admissible late fee.

It is the case of the petitioner that at the relevant point of time, the petitioner was temporarily employed under the Department of Water Resources, River Development and Ganga Rejuvenation, Ministry of Jal Shakti, Government of India and during the month of December and January, when the results were declared, the petitioner was on a field work in a remote area where he faced lack of electricity and network and therefore the declaration of the result was not in notice of the petitioner until the impugned notification dated 05.06.2025 was passed. It is contended by the petitioner that as soon as he came to know about the aforesaid notification that his candidature was rejected on the ground that he failed to submit the documents within the stipulated time for verification as mentioned in the result dated 03.12.2024, the petitioner filed his objection on 10.06.2025 but however no decision has been taken till filing of the present writ petition.

Per contra, the respondents have filed their reply and has contended that the petitioner after passing of the examination was required to submit his documents for verification till 24.12.2024 or within the extended time i.e. 08.01.2025. It is contended by the respondents that under Clause 5 of the result dated 03.12.2023 (Annexure-R-2/2) which reads as under:-
