ORDER

This is second bail application under Section 483 of Bhartiya Nagrik

Suraksha Sanhita, 2023 on behalf of applicant-Vikram Singh S/o Mansingh

who is in custody since 25.7.2025 in connection with Crime No.209/2025

registered at Police Station Padamnagar, District Khandwa under Section 25

(1-B)(A), 25 (1)(A) of the Arms Act.

2. The prosecution case in short is that on 25.7.2025 upon the secret

information, the Police party conducted the checking of the vehicles and

during the checking of the vehicle they stopped one Bolero Neo car and upon

search the Police party seized three pistols from three persons including the

present applicant those were sitting in the car. In addition to the pistols, the

raw material for making of pistol were also seized from the car. The Police

registered the offence and arrested the present applicant and since 25.7.2025

he is in custody. After investigation, charge sheet has been filed.

3. Learned counsel for the applicant submits that applicant is innocent

and has been falsely implicated in the present case. He is in custody since

25.7.2025. The charge sheet has already been filed. Earlier the bail

application was withdrawn on 15.9.2025. The offence is triable by JMFC.

He prays for enlarging the applicant on bail.

4. Learned Government Advocate opposed the bail application on the

ground that not only the pistol but the material required for making the pistol

were also seized from the vehicle and in the past three criminal cases were

registered against the present applicant. He prays for dismissal of the bail

application.

5. Considering the fact that investigation is over, charge sheet has

been filed, offence is triable by JMFC, present applicant is in custody since

25.7.2025 and in the past no case under Section 25 of the Arms Act was

registered against the present applicant, without commenting on the merits of

the case, I deem it proper to allow the bail application.

6. Accordingly, the applicant be released on bail upon furnishing a

personal bond of Rs.50,000/- (Rupees Fifty Thousand Only) along with a

surety of the like amount to the satisfaction of trial court for his regular

appearance before the trial court during trial. The applicant will abide by the

conditions enumerated under Section 480(3) of the BNSS, 2023.

7. Accordingly, M.Cr.C. is allowed.
