ORDER

This criminal revision under Section 19(4) of the Family Courts Act,

1984 is preferred challenging the legality of the order dated 11.02.2020

passed in MJCR No.269/2017 by the Second Additional Principal Judge,

Family Court, Indore whereby only Rs.20,000/- maintenance has been

awarded in favour of the revision petitioner from the date of order.

02. Facts of the case in brief are that the couple married on 20.05.2005

as per Hindu Customs & Rituals. The couple have no issue. An application

for maintenance was preferred on 22.03.2017, alleging neglect in

maintenance, inability to maintain herself and sufficiency of means of the

respondent/husband and prayed for Rs.13,00,000/- per month as

maintenance. The wife preferred an application of interim maintenance also

claiming the same relief.

03. After service of notice, the respondent/husband marked his

appearance and filed the reply of interim maintenance application and

opposed the application submitting that the petitioner/wife is highly

qualified, and she is managing various business activities. She earns lacs of

rupees per month. She has many movable and immovable properties at

Indore, and from her income, she is maintaining herself as well as her

mother. The respondent/husband was employed in Triveni Construction

Company, whereas the petitioner/wife is the owner of a luxury Flat No.205

situated at 2 story of Krishna Apartment situated at Plot No.270-A,

Bhagwati Anpoorna Nagar, Indore. The husband/respondent has to bear the

responsibility of old-aged parents and prayed for rejection of the application.

Thereafter, vide order dated 11.08.2018, an amount of Rs.15,000/- per month

was awarded as interim maintenance then the respondent was not represented

in the case and the order was challenged before the High Court through

Criminal Revision No.5057 of 2018 and vide order dated 10.04.2019, the

amount of interim maintenance was enhanced from Rs.15,000/- to

Rs.20,000/-. Thereafter, the respondent was not represented before the Court.

He made a default in payment of the amount of interim maintenance. Vide

order dated 19.08.2019, the case was proceeded against the

respondent/husband as ex-parte. The revision petitioner examined herself as

PW-1 and adduced the document Exhibit-P/1 to Exhibit-P/74.

04. Appreciating the evidence, the trial Court allowed the application

falsely as mentioned in para 1 of the judgment.

05. Challenging the impugned order, this revision petition has been

preferred on the ground that the trial Court has not appreciated the

documents relating to the means of respondent/husband and committed an

error in awarding the meagre amount of Rs.20,000/- as maintenance.

06. The notice of the present revision was duly issued to the

respondent. However, despite service of notice through registered post, the

respondent/husband did not mark his appearance before this Court.

Consequently, the revision petitioner was heard accordingly.

07. The revision petitioner/complainant, examined as PW-1 has

deposed through eleven paragraphs. Paragraphs 1 to 8 of her deposition are

devoted to the harassment suffered by the revision petitioner at her

matrimonial home. Paragraph 9 pertains to the income & means of the

husband and inability to maintain herself. She has stated that her husband

earns more than Rupees One Crore per annum, and that she requires

Rs.13,00,000/- per month as maintenance. A monthly claim of
