ORDER granted bail by the trial court and in another case, he has already been convicted and in which, the sentence of imprisonment has been suspended by this Court, the copies of which are also placed on record. It is also submitted that the investment in the present case was made in the year 2011; whereas the applicant, who was earlier posted as a driver in the company, was made additional Director in the year 2014, and thus, there is no direct involvement of the applicant. It is also submitted that otherwise also in the present case the applicant is lodged in jail since around seven months however, he is lodged in jail since last two years and ten months as he was earlier arrested in connection with the other crime numbers of the same nature. It is further submitted that the other Directors of the company have already been granted bail by this Court; copies of the bail orders are placed on record.
1] They are heard and perused the case diary/challan papers.
2] This is the applicant's first bail application filed under Section 483 of
Bharatiya Nagrik Suraksha Sanhita, 2023/ 439 of Criminal Procedure Code, 1973, as he / she is implicated in connection with Crime No.555/2023, registered at Police Station Raipuria, District -Jhabua (MP) for offence punishable under Sections 420, 34, 409 of the IPC and Section 6(1) of Madhya Pradesh Nikshepakon Ke Hiton Ka Sanrakshan Adhiniyam, 2000. The applicant is in
custody since 12.05.2025.
2] Allegation against the applicant is of embezzlement as it is alleged that the
applicant and the other accused persons enticed the investors to invest in USK
India Ltd. by assuring them higher returns.
3] Counsel for the applicant has submitted that there are other six cases were
registered against the applicant by various complainants and in one such case,
Crime No. 72/2017, registered at Palasia Police Station, Indore, he has been
Counsel has also submitted that Rs 10 lakhs has already been deposited by the other three accused, as directed by this Court and the applicant is also ready to deposit an amount of Rs.1,00,000/-(Rupees One Lakh only). Thus, It is further submitted that the application deserves to be allowed.
4] Counsel for the respondent / State, on the other hand, has opposed the prayer and it is submitted that total amount embezzled is Rs. 8,64,000/-.
5] Having considered the rival submissions and on perusal of the case diary, and taking note of the fact that the applicant is ready to deposit an amount of Rs.1,00,000/-, this Court finds force in the submissions as advanced by counsel for the applicant, and further taking note of the fact that the applicant is lodged in jail since 12.05.2025 and the final conclusion of the trial is likely to take sufficient long time, in the considered opinion of this Court, the applicant's application can be allowed. Thus, without reflecting anything on the merits of the case, the application filed on behalf of the applicant is hereby allowed subject to deposit a sum of Rs.1,00,000/- (Rupees One Lakh only) by the applicant, as directed below and the said amount shall be subject to the final outcome of the case by the trial Court.
6] It is further directed that upon applicant's or any other person on his behalf depositing a sum of Rs.1,00,000/- (Rupees One Lakh only) in a fixed deposit in a nationalized bank and producing the receipt/certificate of the same before the concerned trial Court, he shall be released on bail on his furnishing a bond in the sum of Rs.25,000/- (Rupees twenty five thousand only) with one surety bond of the same amount to the satisfaction of the trial Court, to appear before the trial Court on the dates given by the Court.
