ORDER (PW-2) has been recorded on 26.11.2025. As per prosecution case the allegation levelled against the appellant is of committing penetrative sexual intercourse on the pretext of promise of false marriage and making viral the photographs. The report was lodged when the mobile phone provided by the appellant/accused was seen by the elder sister of the prosecutrix (PW-2) and thereafter, the prosecutrix (PW-2) left the home.
This is repeat second criminal appeal under section 14A (2) of the SC
& ST (Prevention of Atrocities Act, 1989 is preferred against the order dated 10.12.2025 in BA No.128/2025 by Special Judge, SC & ST (POA) Act, 1989, Mandleshwar, whereby the trial court has rejected the application filed under section 483 of the BNSS, 2023 by the appellant SAMEER SHAIKH seeking bail in connection with Crime No.231/2025 registered at police station- Karahi, District- Khargone (M.P.) for the offence punishable under sections 64(2)(M), 69, 351(3) of the BNS, 2023 and section 3(1)(w)(i) and
3(2)(v) of SC/ST Act, 1989.
First criminal appeal of the appellant was dismissed as withdrawn vide
order dated 07.10.2025 in CRA No.9441/2025 and thereafter this repeat appeal has been preferred on the ground that statement of the prosecutrix
Counsel for the State as well as counsel for the Objector have opposed the criminal appeal and prayed for its rejection.
Considering the fact and circumstances of the case, without commenting on the merit of the case, the appeal is allowed with conditions and the appellant- SAMEER SHAIKH is directed to be released on bail upon his furnishing personal bond in the sum of Rs.50,000/- (Rupees Fifty Thousand)with solvent surety in the like amount to the satisfaction of the trial court for his appearance before that Court, as and when directed, during the pendency of trial and shall also abide by the conditions enumerated under section 480 (3) of the B.N.S.S., 2023 along with the following conditions :-(For convenience of understanding by accused and surety, the conditions of bail are also reproduced in Hindi as under):-
(1) Appellant shall remain present on every date of hearing as may be directed by the concerned court;
(1) आवेदक संबंिधत (cid:12)यायालय के िनद(cid:17)शानुसार सुनवाई क(cid:22) (cid:23)(cid:24)येक ितिथ पर उप(cid:28)(cid:29)थत रहेगा ।
(2) Appellant shall not commit or get involved in any offence of similar nature;
(2) आवेदक समान (cid:23)कृित का केाई अपराध नह(cid:36)ं करेगा या उसम(cid:37) स(cid:28)(cid:38)मिलत नह(cid:36)ं होगा ।
(3) Appellant shall not directly or indirectly make any inducement, threat or promise to any person acquainted with the facts of the case so as to dissuade them/him/her from disclosing such facts to the Court or to the police officer;
(3) आवेदक (cid:23)करण के त(cid:41)य(cid:42) से प(cid:43)रिचत (cid:45)कसी (cid:47)य(cid:48)(cid:49) को (cid:23)(cid:24)य(cid:50) या अ(cid:23)(cid:24)य(cid:50) (cid:51)प से (cid:23)लोभन, धमक(cid:22) या वचन नह(cid:36)ं देगा, (cid:28)जससे ऐसा (cid:47)य(cid:48)(cid:49) ऐसे त(cid:41)य(cid:42) को (cid:12)यायालय या पुिलस अिधकार(cid:36) को (cid:23)कट करने से िनवा(cid:43)रत हो ।
(4) Appellant shall not directly or indirectly attempt to tamper with the evidence or allure, pressurize or threaten the witness;
(4) आवदेक (cid:23)(cid:24)य(cid:50) या अ(cid:23)(cid:24)य(cid:50) (cid:51)प से सा(cid:56) य के साथ छेडछाड करने का या सा(cid:50)ी
या सा(cid:28)(cid:50)य(cid:42) को बहलाने-फुसलाने, दबाव डालने या धमकाने का (cid:23)यास नह(cid:36)ं करेगा ।
