The present petition has been filed by the petitioner under Article 226
of the Constitution of India challenging the order dated 12.11.2025 passed by the respondent No.3, Secretary, Department of Transport, Bhopal (MP) by which the Automated Testing Station (ATS) shall be inspected/checked by RTO/ARTO/DTO and they shall be empowered for conducting the enquiry
and regular inspection of these ATS.
It has been contended by the petitioner that by this order, the
respondent No.3 has also empowered these officers for initiating criminal penal action against the RTOs in case of lapses found on their part.
