Heard on I.A.No.983 of 2026, an application for taking into

consideration the grant of temporary bail to the applicant.

The applicant has prayed for temporary bail for a period of three

months for treatment of his ailing mother, who is suffering from serious disease of liver cirrhosis. Medical reports are filed along with the application. Learned Counsel for the State on last occasion was directed to

verify the same from the concerned hospital.

Today, Counsel for the State has submitted that on verification it is

found that treatment of the mother of the applicant is going on and she is actually suffering from the liver cirrhosis as per the report received from the concerned Officer after due verification. He has further submitted that the documents which are produced along with e application are also genuine

Considering the same and considering the nature of ailment and considering the allegation against the applicant, the application for temporary bail is required to be considered for the period of thirty days. Consequently, I.A.No.983 of 2026 is allowed.

Accordingly, it is directed that applicant be released on temporary bail for a period of one month from the date of his release on his furnishing a personal bond in the sum of Rs.50,000/- (Rupees Fifty Thousand only) with one solvent surety in the like amount to the satisfaction of the trial Court, for his regular appearance before the trial Court during trial with a condition that he shall remain present before the concerned Court on all the dates fixed by it during trial. He shall abide by all the conditions enumerated under Section

480(3) of Bharatiya Nagarik Suraksha Sanhita, 2023.

However, it is made clear that applicant shall surrender immediately on completion of period of one month from the date of his release, on 30th day he shall surrender back to the concerned trial court before 5:00 O'clock on that day. It is also made clear that if the applicant does not surrender after prescribed period of one months/30 days then, trial Court shall be free to take necessary steps for taking him into custody. During applicant's release on bail for one month, he will mark his appearance on every Monday before the concerned Police Station during this period of one month. He will not take undue advantage of his liberty.

In view of consideration of temporary bail application, without arguing much on the merits of the case, Counsel for the applicant seeks permission to withdraw the main bail application i.e. the present M.Cr.C., at this stage with a liberty to file the same in near future after surrender before the trial court.

M.Cr.C. stands dismissed as withdrawn with aforesaid liberty .
