ORDER old and on the date of incident i.e. 03.10.2025. Allegations are that the victim was called to follow the revision petitioner to the house of 'g' (child in conflict with the law) where the revision petitioner along with others took the victim to the bathroom, caught his face and assaulted him by inserting their private parts in his mouth one by one. Revision petitioner was apprehended on 09.10.2025 and the concerned J.J. Board rejected the application under section 12 of the JJ Act, 2015 on the ground that allegations against the revision petitioner is heinous in nature and will frustrate the end of justice. Further it was observed that it is in the interest of child in conflict with law that application be rejected.

This criminal revision under section 102 of the of the Juvenile Justice

(Care and Protection of Children), Act, 2015 (for short 'the JJ Act, 2015') is preferred challenging the order dated 12.11.2025 in Criminal Appeal

No.303/2025 (Annexure-P/1) by the 29 Additional Sessions Judge, Indore (M.P.) arising out of order dated 12.11.2025 by 29th Additional Sessions Judge, Indore whereby the application under section 12 of the JJ Act, 2015 in connection with crime No.222/2025 registered at P.S.- Ravjibazar, Indore (M.P.) under section 137(2), 140(4) of the BNS, 2023 and sections 5,5(g) and 5(m)/6 of the POCSO Act, 2012 has been rejected on the ground that releasing the child on bail might cause him moral and psychological damage and that handing over the child to responsible guardian will defeat the ends

of justice.

2. Facts of the case in brief are that revision petitioner was 14 years

3. The order was challenged through section 101 of the JJ Act, 2015 and the appellate court has affirmed the order of the Principal Magistrate JJ Board and recorded the finding that revision petitioner is exposed to moral and psychological danger and if he is released on bail then there is further possibility of exposed to physical and psychological danger. He further recorded the finding that there is possibility that witnesses will be adversely affected and end of justice will be frustrated.

4. Challenging the finding of Principal Magistrate JJ Board and Children Court, this criminal revision is preferred for verification of the findings of Principal Magistrate JJ Board, Indore and Children Court, Indore and a report of social investigation report was collected and social investigation report discloses that there is no prior exposure of the revision petitioner to the criminal activities and the finding of the social investigation report is disclosed below:-

बालक के माता-(cid:32)पता म(cid:29) िश(cid:6)ा का (cid:33)तर कम है परंतु अपने पु(cid:36) को िश(cid:6)ण (cid:38)दान करवा रहे ह(cid:40)। (cid:32)पता मजदरू(cid:12) करते है। बालक क(cid:6)ा 11th म(cid:29) िश(cid:6)न (cid:24)ा(cid:43) कर रहा है। बालक सोशल मी(cid:44)डया (cid:46)लेटफॉम(cid:22) इं(cid:33)टा(cid:50)ाम एवं (cid:52)हा(cid:53)स ऐप ऑपरेट करता ह(cid:40)। बालक लगभग 2 माह से स(cid:58)(cid:38)े(cid:6)ण गहृ क(cid:60) आभर(cid:6)ा म(cid:29) है। बालक सं(cid:33)था के दैिनक (cid:44)दनचया(cid:22) का पालन कर रहा है। बालक के भ(cid:32)व(cid:64)य को (cid:65)(cid:32)(cid:66)गत रखते हुने उसे प(cid:2)रवार के मा(cid:69)यम से

पुनवास(cid:22) (cid:44)कया जाना उिचत (cid:38)तीत होका।"

5. The report further discloses that child in conflict with the law is studying in 11th standard.
