ORDER This is first criminal appeal under section 14A (2) of the SC & ST (Prevention of Atrocities Act, 1989 is preferred being aggrieved by order dated 04.12.2025 in BA No.1688/2025 (SCATR No.176 of 2025 (Annexure-P/1) by the Special Judge, SC/ST (POA) Act, 1989, Mandsaur whereby the application for bail of the appellant- MUBARIK who was apprehended on 01.11.2025 in connection with Crime No.451/2025 registered at P.S- Garot, District- Mandsaur under sections 69, 351(3) of BNS, 2023 read with sections 3(2)(v), 3(2)(va) and

3(1)(w)(ii), of the SC & ST (POA) Act, 1989 has been rejected.

2. The case of the prosecution is that the appellant who does not belongs to SC/ST community came in contact with the prosecutrix, who belongs to the schedule community, when he was cultivating agricultural field belonging to the victim on lease & subjected to sexual intercourse
