ORDER In compliance of earlier order Shri Raman Singh Markam, Town Inspector Police Station, Khitola, District Jabalpur is present before this Court. The Investigating Officer has assured the court that he will make all efforts to carry out the investigation in prompt, fair and reasonable manner.
2. This is first bail application filed on behalf of applicant under Section 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023 in connection with Crime No.345/2025 registered at P.S. Khitola, District- Jabalpur for the offence punishable under Sections 191(2), 191(3), 296(A), 333, 324(5), 109(1) of BNS, 2023. Applicant is in detention since 19.11.2025.
3. As per prosecution story, the informant Ruchika Patel lodged First Information Report with P.S.Khitola against present applicant and other co-
accused persons for offences punishable Under Sections 191(2), 191(3), 296(A), 333, 324(5), 109(1) of Bhartiya Nyaya Sanhita, 2023 registered vide Crime No.345/2025 with allegations that on 05.11.2025 at about 08.00 a.m., when she was in her house, at that time, Anand Prakash Patel and other family members namely Jitendra Patel, Pragati Patel, Shiva Patel, Ranjeet Patel, Ashwin Patel, Prashant Patel, Sukhchain Patel, Hariom Patel, Arjun Patel, Arvind Patel, Gouri Patel, Lalu & Patel, Manoj Patel & Sumit Patel came over there armed with deadly weapons like ‘Bakka’, Lathi/Danda and on account of previous animosity regarding agricultural land, started filthily abusing her. Upon hearing cries, her mother-in-law Meena Bai Patel came out of house, at that time, all the accused persons also abused her filthily. It is further alleged that as soon as Meena Bai Patel went inside house, all the accused persons forcibly entered into her house and co-accused Anand Prakash Patel assaulted her with ‘Bakka’. When her ‘Nanad’ Anamika Patel came to pacify quarrel, co-accused Anand Prakash Patel also assaulted her with ‘Bakka’. It is further alleged that all the co-accused persons forcibly entered into house with ‘Danda’ and sword and destroyed household articles. On the basis of aforesaid information, offences as aforementioned have been registered against present applicant and other co-accused persons. F.I.R was registered.
4. Learned counsel for the applicant submits that it was case of free fight. A counter case has also been registered against the complainant and other persons. The role of the applicant is that he assaulted the complainant party with stick. The applicant is aged 55 years. The trial of the case will take considerable time. Therefore, it has been prayed that the applicant be released on bail pending the trial.
5. Learned counsel for the State as well as learned counsel for the complainant have opposed the prayer for grant of bail.
6. Considering the fact that a counter case is also pending between the parties and detention period of the applicant and considering the role of the present applicant, who is 55 years of age and also the fact that trial will take considerable time to conclude, I am inclined to release the applicant on bail.
Consequently, bail application filed on behalf of applicant, stands allowed.
7. It is directed that applicant be released on bail on his furnishing a personal bond in the sum of Rs.50,000/- (Rupees Fifty Thousand only) with one solvent surety in the like amount to the satisfaction of the trial Court, for his regular appearance before the trial Court during trial with a condition that he shall remain present before the concerned Court on all the dates fixed by it during trial.
