ORDER The present Petition has been filed challenging the Order dated

12.11.2025 whereby the Trial Court has dismissed the suit in absence of the Plaintiff and his witnesses, though the counsel for the Plaintiff was present. The Trial Court has dismissed the suit under Order 17 Rule 2 and 3 of the C.P.C.

2. The present Revision is at instance of the Plaintiff and the Trial Court by the impugned Order has dismissed the suit in absence of the Plaintiff and his witnesses though the counsel was present. The Trial Court noted that a number of opportunities have been granted to the Plaintiff to lead evidence but despite that the Plaintiff and his witnesses are not present before the Court. The Court rejected the application under Order 17 Rule 1 of the C.P.C. for adjournment and consequently, dismissed the suit under Order 17 Rule 2 and 3.
