ORDER Per: Justice Vivek Rusia The appellant has filed the present appeal challenging the order of writ Court dated 13.02.2024 (Annexure A/1), whereby W.P. No.15074/2022 has been dismissed.

Facts of the case, in short, are as under:-

2. The appellant's father (Late Shri Hiralal) was a member of the Central Reserve Police Force (CRPF) and was posted as Constable/DFT in the G.C. at C.R.P.F., Bhopal. He died on 20.06.2020 due to 'Sudden Respiratory and Cardiac Arrest'. The appellant, being his dependent son, applied for a compassionate appointment in the CRPF organization. The application was rejected by the respondents vide order dated 06.07.2020 (Annexure P/1), firstly on the ground that the death was normal for which the department or any employee could be held responsible; and secondly, all the terminal benefits have already been given to the family after his death, which are sufficient for the survival of dependents.

The appellant submitted a representation to the respondent No.1 on the ground that the "Competent Authority has not accorded approval for assessment of the suitability of the applicant being financially sound". According to the mother of the appellant, she has two sons and an unmarried daughter, and terminal dues would not be sufficient for survival, as well as marriage. The family does not possess any immovable property except 2.631 hectares in the name of the father-in-law, in which there is a share of four sons and two daughters. She has also pleaded that there is a home loan of Rs. 13,12,000/-, for which she is paying installment.

Some time in April 2020 vide Annexure P/6), the appellant was informed about the rejection of the claim of compassionate appointment in view of the various circulars issued by the DoP&T, mentioned therein. Being aggrieved by the aforesaid rejection, the appellant filed a writ petition before this Court. After notice, the respondents filed a reply in support of the impugned rejection order. It is stated in the reply that as intimated by the DIG (Recruitment) Directorate, New Delhi vide signal No.A.VI-15/2022- Rectt-DA-9 dated 16/02/2022, that A BOOs (Board of Officers) had been detailed at the Directorate General, CRPF, New Delhi for assessment of suitability/skill test of 163 Candidates for various posts of the Department (CRPF), in the suitability assessment process on compassionate ground and as approved by the Competent authority, 126 candidates out of 163 candidates were found eligible . After such assessment, the DIG (Recruitment) Directorate, New Delhi vide letter mentioned above, conveyed that the Competent authority did not accord approval for assessment of suitability of 11 applicants (the name of the appellant was also included in Appendix-B), being financially sound. The rejection was further conveyed to the appellant by the DIG, Group Centre, CRPF, Bhopal vide letter No. A.VI.06/2022-EC-V dated 12/04/2022. It is respectfully submitted that the appellant applied for the post of Constable/Bugler, but the higher authority directed that no vacancy is available in the applied post, and the financial condition of the appellant is sound. The competent authority has considered the case of the appellant, but the same resulted in rejection as per the uniform guidelines and laid down procedure. Accordingly, the same was intimated by the DIG (Recruitment), Directorate, New Delhi vide signal No.A.VI- 15/2022-Rectt-DA-9 dated 16/02/2022.
