ORDER

The applicant has filed this first interim bail application u/S. 483 of

BNSS for grant of interim bail. Applicant has been arrested on 18.09.2025 in

connection with Crime No.170/2025 registered at Police Station- Ambah,

District Morena for the offence punishable under Sections 103(1), 296, 109,

191(2), 191(3), 190 of BNS.

2. Learned counsel for the applicant pressed for temporary/interim bail

to attend the marriage of his sister. The marriage of the sister of applicant is

likely to be held 05.02.2026. Being brother, he has to participate in many

rituals, therefore, he sought one month's period for interim bail. Marriage

card is attached with the application. Thus, prayed for temporary bail.

3 . Learned counsel for the respondent/State verified the fact and

submitted that sister of applicant is going to be wedded on 05.02.2026.

However, learned counsel for complainant vehemently opposed the

application for bail and prayed for its rejection by submitting that the

applicant is a habitual absconder and he may flee from the court of law.

4. Heard the learned counsel for the parties and perused the case diary.

5. Considering the submissions of learned counsel for the parties and

on the basis of verification and the fact of marriage of sister of applicant, this

Court allows the application for temporary bail.

6. It is hereby directed that the applicant shall be released for 10 days

only till 09.02.2026 on his furnishing personal bond of Rs.50,000/- (Rupees

Fifty Thousand Only) with one solvent surety in the like amount to the

satisfaction of trial Court. The applicant shall have to surrender on or before

09.02.2026 before the Trial Court. Surrender report shall be submitted by the

concerned Court to the Office of this Court for information.

7 . This order will remain operative subject to compliance of the

following conditions by the applicant:-

i) The applicant will comply with all the terms and conditions of the

bond executed by him;

ii) The applicant will cooperate in the investigation/trial, as the case

may be;

iii ) The applicant will not indulge himself in extending inducement,

threat or promise to any person acquainted with the facts of the case so as to

dissuade him/her from disclosing such facts to the Court or to the Police

Officer, as the case may be;

iv) The applicant will not commit any other offence or will not repeat

the offence in future. In case, if he/she is found involving in the offence of

same nature, this bail order shall stand cancelled automatically without

further reference to the Bench.

v) The applicant will not seek unnecessary adjournments during the

trial; and

vi) The applicant will not leave India without previous permission of

the trial Court/Investigating Officer, as the case may be.

vii) Applicant is directed to mark his presence before the police station

Ambah District-Morena on 07.02.2026.

8. The application stands disposed of in above terms and it is directed

that the applicant shall have to surrender on or before 09.02.2026.

9. Copy of this order be sent to the trial Court concerned for

compliance.
