ORDER This criminal revision under section 397 read with section 401 of the Cr.P.C./ Section 438 read with section 442 of the B.N.S.S., 2023 is preferred being aggrieved by order dated 23.07.2024 in ST No.62/2022 by the Second Additional Sessions Judge, Dr. Ambedkar Nagar (Mhow), District Indore whereby prayer for interim custody of the mobile phone bearing IMEI No.357624692752989 (iPhone 13 Pro Max) seized in connection with crime no.252/2022 registered at P.S.-Kishanganj, District Indore under sections

302, 307, 323, 294, 147, 148 and 149 of the IPC has been rejected.

2. The trial Court has rejected the application on the ground that the aforesaid mobile (iPhone 13 Pro Max) is the subject matter of evidence, and if the mobile phone is handed over for interim custody, then there is a possibility that the data of the mobile may be interfered.
