ORDER This Miscellaneous Petition under Article 227 of the Constitution of India has been filed by petitioner- defendant challenging the order dated 15- 12-2025 passed by First Civil Judge, Senior Division, Dabra, District Gwalior (hereinafter referred to as "trial court") in Regular Civil Suit No. 04- B of 2022, whereby trial Court rejected petitioner’s application filed under Order 14 Rule 5 CPC for framing additional issues.

2. The facts giving rise to present petition, as narrated therein, are that respondent- plaintiff in trial Court is the proprietor of Shanti Cold Storage and Ice Factory, a registered business where goods, particularly agricultural produce such as potatoes, are stored. Petitioner, a businessman dealing in potatoes, entered into a contract with respondent to store a certain quantity of potatoes in respondent's cold storage. Agreed storage period
