This revision is filed against the order dated 17.4.2012 passed in Cr.A.

No.436 of 2011 by learned Special Sessions Judge, Bhopal dismissing the appeal and confirming the judgment of the trial court arising out of judgment dated 27.5.2011 passed by J.M.F.C. Bhopal in R.T. No.383 of 2004 by which the accused has been acquitted from the charges under Section 420 of IPC.

The appellate court while rejecting the appeal of the complainant against acquittal has mentioned that at best the complainant could have moved to recover the money by filing a civil suit.

Hon'ble Supreme Court in the case of Sailesh Kumar Singh Alias Shailesh R. Singh Vs State of Uttar Pradesh & Others; CRA No. 2963/2025 decided on 14.07.2025; 2025 INSC 869, disapproved the practice of using criminal proceeding as a substitute for civil remedies observing that money
