The petitioner has filed this present writ petition challenging the order

dated 28.10.2014 (Annexure P-8) whereby the respondents Nos 1 and 2 have

rejected his representation for the release of the original documents of the

petitioner and have posted him to District Hospital, Jhabua, for a period of 1

year.

2. The facts of the case, in short, are as follows:-

(a) The petitioner completed his M.B.B.S in the year 2007. Thereafter,

he completed his one-year internship and was awarded the degree of

M.B.B.S. He then appeared in the entrance test to take admission in the

Postgraduate Course, i.e., M.D./M.S., in the academic session 2010-11. The

petitioner was selected and admitted to the M.G.M Medical College, Indore,

in the department of Anaesthesiology. The petitioner has executed a Bond

(Annexure P-1) for working in rural/ remote areas of this State (other than

the city and areas attached to the major cities) after completion of the PG

degree. The petitioner deposited the original mark sheets and documents with

the respondent no.4 till become free from the bond and issuance of NOC.

The petitioner completed the PG course in the year 2011, and the result was

declared on 15.07.2011 (Annexure P-3).

(b) According to the petitioner, he was expecting his rural posting

order, but no order was issued by the respondent no.3 till date of passing of

the impugned order. According to the petitioner, as per Rule 1.12 of the

Examination and Conduct Rules, 2009-10, if a posting order is not issued

within 3 months from the date of declaration of result, the bond will

automatically be deemed cancelled. Since the appointment order was not

issued for rural posting; therefore, the petitioner is free from the bond

conditions and entitled to get back his original documents. The petitioner

filed W.P No. 936/2014 before this Court. Vide order dated 04.02.2014

(Annexure P-6), the Court directed the respondents to decide his

representation. In compliance of the aforesaid direction, the respondent no.3

did not pass an order; therefore, the petitioner filed contempt petition No.

1499/2014 before this Court. According to the petitioner, the contemnors got

annoyed after receipt of the notice of contempt, hence vide order dated

28.10.2014 (Annexure P-8), the representation of the petitioner has been

rejected and he has been directed to join as P.G doctor in District Hospital,

Jhabua. The petitioner by way of this petition is seeking following relief as

well as interim relief:-

"(i) To quash the order dated 28.10.2014 (Annexure P-8);

(ii) To direct the respondents to grant the NOC in favour of the petitioner and release

the original documents and mark sheets retained by them.

(iii) Grant any other relief as deemed fit and proper in the circumstances of this case.

8. Interim order/writ:

It is respectfully submitted that the petitioner is hopeful of succeeding in the case

and therefore during the pendency of the instant Writ Petition this hon’ble court may

kindly be pleased to stay the effect of impugned order dated 28/10/2014 (Annexure

P-8)."

3. While issuing notice to the respondents, this Court has not stayed

the posting order; therefore, in consequence of it, the petitioner ought to have

worked for one year in a rural area in Jhabu
