Applicant has filed this second bail application u/S.483 of BNSS 2023 for grant of bail in connection with Crime No.96/25 registered at Police Station Ambah, District Morena (M.P.) for the offence punishable under Sections 109, 324(4), 3(5), 115(2) of BNS & 25/27 of Arms Act.

Learned counsel for the applicant confined his argument to the fact that he has filed an application I.A. No.2485/2026 for interim bail on the ground of the niece of the present applicant.

Heard on I.A. No.2485/2026.

It is submitted that the marriage of niece of present applicant is going to be solemnized on 10.02.2026 and in support of his submission, a marriage card has been annexed herewith. Hence, he prays that on the ground of marriage of the niece of the applicant, he may be granted interim bail for ten days.

The fact of marriage of the niece of the present applicant was verified by the counsel for the State.

Thus, looking to the facts and circumstances of the case, the marriage of the niece of the present applicant is going to be solemnized on

10.02.2026, this Court deems it fit to grant interim bail to the applicant and it is hereby directed that the applicant shall be released on interim bail on his furnishing a personal bond in the sum of Rs.50,000/- (Rupees Fifty Thousand only) with one solvent surety of the like amount to the satisfaction of the concerned trial court.

The applicant shall positively surrender before the trial court concerned on or before 17.02.2026, failing which, the interim bail order shall stand cancelled automatically without further reference to this Court and the trial court shall be at liberty to take the applicant into custody forthwith. This order will remain operative subject to compliance of the following conditions by the applicant:-

1) The applicant will comply with all the terms and conditions of the bond executed by him;

2) The applicant will cooperate in the investigation/trial, as the case may be;

3) The applicant will not indulge himself in extending inducement, threat or promise to any person acquainted with the facts of the case so as to dissuade him/her from disclosing such facts to the Court or to the Police Officer, as the case may be;

4) The applicant will not commit any other offence during pendency of the trial, failing which, this bail order shall stand cancelled automatically without further reference to the Bench.

5) The applicant will not seek unnecessary adjournments during the trial; and

6) The applicant will not leave India without previous permission of the trial Court/Investigating Officer, as the case may be.

7. Looking to the criminal history of the present applicant, he shall mark his presence before the concerning Police Station from 11.02.2026 to 16.02.2026, failing which this bail order shall stand cancelled automatically without further reference to the Court.

Accordingly, I.A.No.2485/26 stands disposed of.

List this case along with the surrender report after a week.

A copy of this order be sent to the court below for necessary information and compliance.
