Supporting the order of rejection of nomination form, learned counsel for the respondent 3 submits that since on the date of submission of nomination form, the petitioner was not eligible, therefore, no illegality is there in the order of rejection and the petitioner has no cause of action to file instant election petition, hence the petition deserves to be rejected/dismissed.
