ORDER This misc. appeal filed by the appellants/claimants under Section 173(1)

of the Motor Vehicles Act, 1988 is preferred challenging the impugned award dated 26.09.2014 passed in Claim Case No.83/2013 by VIIth Additional Member of the MACT, Ujjain whereby an amount of Rs.3,23,000/- has been awarded with interest @ 9% from the date of filing the claim petition.

2. Facts of the case in brief are that deceased labourer Aarif aged about 30 years was traveling on his cycle towards his house at around 7:00 am in the morning when he was dashed by a Maruti Car bearing registration No.MP 09 CH 6812. The offending vehicle was driven rashly and negligently by respondent No.1 causing injuries to him and due to which he succumbed to his injuries. The incident was reported to the concerned Police
