ORDER

This petition has been filed by the petitioner while praying for the

following reliefs:

"(i) To issue a writ in the nature of certiorari order

dated02/06/11 (Annexure P/1) and 15/12/11 (Annexure

P/2) be quashed, being contrary to the dictum of

Hon’ble High Court

(ii) That the Hon’ble Court may be pleased to issue

adirection to the respondents for reinstate to the

petitioner in the service on the basis of the original

caste certificate issued by the competent authority

on10/06/11.

(iii) That the Hon’ble Court may be pleased to grant any

other relief it deems fit and proper."

2. The facts of the case in a nutshell are that the petitioner was

appointed as a constable in the C.I.S.F. under the OBC category. After

completion of her probation, she was initially posted at C.I.S.F. Unit IGI

Airport, New Delhi. At this point, the petitioner's OBC Certificate was sent

for verification to the District Authority, and after due scrutiny, it was found

that the Caste Certificate was never recorded in the record register.

Consequentially, the services of the petitioner were terminated under Rule 26

of the C.IS.F. Rules, 2001, on the ground that he procured employment by

producing a false caste certificate. The said order was challenged before the

Office of the Special Director General Airport Sector, C.I.S.F., but the same

was rejected vide Annexure P/2. Being aggrieved, the petitioner has

approached this Court assailing the aforesaid impugned orders.

3. Learned counsel for the petitioner contends that the petitioner had

applied for the post of constable along with all the requisite documents,

including the Caste Certificate certifying that he belongs to the 'Kachi'

community under the OBC Category, believing it to be a genuine document.

Learned counsel further contends that the petitioner had engaged two

advocates for the preparation of the Caste Certificate and therefore no mala

fides can be attributed in the conduct of the petitioner. The petitioner

genuinely belongs to OBC category Moreover, the impugned orders have

been passed without affording an opportunity of hearing to the petitioner,

and the same being in contravention of the Principles of Natural Justice are

liable to be set aside.

4. Per contra, learned counsel for the respondents submits that the

conduct of the petitioner does not deserve the assistance of this Court,

inasmuch as the petitioner has approached this Court with unclean hands.

The petitioner has secured employment by producing a fabricated OBC

Certificate. It is the further contention of the learned counsel that the

department has passed the order of termination of the petitioner's services

after due scrutiny of the caste certificate, careful perusal of the reports of the

District Authorities, and proper compliance with the procedural rules in tune

with Rule 26 of the C.I.S.F. Rules, 2001. In view of the aforesaid, the

petition deserves to be dismissed.

5. No other point is pressed or argued by the parties.

6. Heard learned counsel for the rival parties and perused the records.

A perusal of the record reflects that the petitioner was appointed as a

constable in the C.I.S.F. on the basis of an OBC Certificate vide an order

dated 15.08.2009. As per the existing procedure, her OBC Certificate was

sent for verification to the concerned district authorities, who, after due

scrutiny did not find
