ORDER This is second application filed under Section 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023 by the applicant for grant of regular bail relating to FIR/Crime No.01/2026 registered at Police Station Sanchi, District Raisen, for the offence punishable under Sections 303(2), 317(2) of B.N.S. Applicant is in jail since 01.01.2026. Applicant's first application was dismissed as withdrawn vide order dated 22.01.2026 passed in MCRC No.1510/2026 with liberty to revive his prayer after filing of charge sheet.
2. As per the prosecution case, on 13.12.2025 a motorcycle of the complainant was stolen. During investigation, co-accused Avadhnarayan Sharma disclosed in his memorandum that he had stolen six motorcycle out of which two motorcycles have been sold to the present applicant. It is further submitted that two motorcycle were recovered from the present applicant for which the present offence and another offence vide Crime No.3/2026 registered against the applicant.
3. Learned counsel for the respondent/State submits that the applicant is innocent and has falsely been implicated. Applicant is in jail since 01.01.2026. Charge sheet has been filed and there is no apprehension of the applicant's absconding or tampering with the prosecution evidence. Thus, it is prayed that the applicant may be released on regular bail.
4. Per contra, the counsel for the respondent/State has opposed the bail application.
5. Considering overall facts and circumstances of the case, no useful purpose would be served in keeping the applicant behind the bars till conclusion of the trial. I am inclined to enlarge the applicant on bail subject to some stringent condition. Thus, without commenting anything on the merits of the case, this application is allowed.

It is directed that the applicant namely Sameer Mansoori be enlarged on bail on his furnishing a personal bond in the sum of Rs.50,000/- (Rupees Fifty Thousand) with one surety in the like amount to the satisfaction of the trial court concerned for his appearance before the said Court on all such dates as may be fixed in this regard during pendency of the trial.
7. It is further directed that the applicant shall comply with the provisions of Section 480 (3) of BNSS.
8. It is made clear that in case of any subsequent registration of alike offence against the present applicant, it shall be considered as violation of the conditions of this bail order and in that event, the applicant would become disentitled to remain on bail under this order and trial Court shall be free to treat this order as cancelled and proceed against applicant further in accordance with law.
9. Accordingly, this M.Cr.C. stands allowed and disposed of.
