ORDER This misc. appeal has been filed against the impugned award dated
19.10.2023 passed in MACC No.15/2023 whereby the injured/appellant has awarded an amount of Rs.2,87,000/- alongwith interest which is challenged before this Court.
2. Learned counsel for the appellant submits that though proof with regard to the income of the injured was given during trial but learned Claims Tribunal has failed to consider the same and considered the income Rs.7,000/- per month only in para 20 of the award. Whereas even as per the circular issued by the Labour Department under the Minimum Wages Act the income of the unskilled labourers comes to Rs.9,125/- per month therefore, atleast the same should have been considered. On this account, he prays for enhancement of the compensation award.
3. Per contra, learned counsel for the respondent/Insurance company has opposed the prayer on the ground that
