ORDER The petitioner has filed this petition seeking following reliefs; "(7.1) (cid:1)पट(cid:4)शनर क(cid:9) (cid:1)पट(cid:4)शन को (cid:11)वीकार करते हुए, (cid:1)पट(cid:4)शनर के िनयु(cid:1)(cid:22) / पद(cid:11)थापना आदेश (cid:26)दनांक 10.07.2020 (अने(cid:29)जर पी-1) म(cid:32) मनमाने (cid:33)प से, जानबूझकर, आदेश म(cid:32) ह(cid:11)तिल(cid:1)प से संशोधन कर, ड(cid:4).एड. (cid:42)िश(cid:43)ण कोस (cid:45) अिनवाय (cid:45) (cid:33)प से (cid:26)कये जाने क(cid:9) शत (cid:45) को म(cid:46)य(cid:42)देश पंचायत सं(cid:1)वदा शाला िश(cid:43)क (िनयोजन एवं सं(cid:1)वदा क(cid:9) शत)(cid:48) िनयम 2005 एवं माननीय उ(cid:50)चतम (cid:51)यायालय एवं माननीय (cid:51)यायालय के आदेश(cid:52) के पालन के कम म(cid:32) िनर(cid:11)त/अपा(cid:11)त (cid:26)कये जाने क(cid:9) कृपा क(cid:9) जाव(cid:32) अथवा (cid:1)वक(cid:54)प म(cid:32) िनवेदन है (cid:26)क (cid:1)पट(cid:4)शनर को सं(cid:1)वदा शाला िश(cid:43)क वग-(cid:45) 3 क(cid:9) पा(cid:57)ता पर(cid:4)(cid:43)ा 2005 के समय ड(cid:4).एड. (cid:42)िश(cid:43)ण कोस (cid:45) म(cid:32) (cid:42)वेश के लागू/(cid:42)चिलत िनयम के अनुसार ह(cid:4) शासक(cid:9)य अनुमित उपरांत िनयमानुसार शासक(cid:9)य (cid:58)यय पर पा(cid:59)य(cid:60)म म(cid:32) सं(cid:1)वदा शाला िश(cid:43)क वग-(cid:45) 3 क(cid:9) पा(cid:57)ता पर(cid:4)(cid:43)ा 2005, चयन के समय लागू थे के ह(cid:4) (cid:60)म म(cid:32) ड(cid:4).एड. (cid:42)िश(cid:43)ण कोस (cid:45) म(cid:32) (cid:42)वेश हेत ु अनुमित (cid:42)दान (cid:26)कये जाने के आदेश/िनद(cid:48)श एक माह म(cid:32) (cid:42)दान (cid:26)कये जाने क(cid:9) कृपा कर(cid:32)।

(7.2) अ(cid:51)य उिचत (cid:62)रट, आदेश अथवा िनद(cid:48)श (cid:51)याय (cid:26)हत म(cid:32) (cid:1)पट(cid:4)शनर के प(cid:43) म(cid:32) जार(cid:4) करने क(cid:9) कृपा कर(cid:32), (cid:42)करण (cid:58)यय (cid:62)र(cid:11)पो(cid:51)डे(cid:51)(cid:63)स से (cid:26)दलाये जाने क(cid:9) कृपा कर(cid:32)।"

The facts necessary for decision of this case are that the petitioner appeared in the examination conducted by Professional Examination Board for the post of Samvida Shala Shikshak Grade III in the year 2005. She secured 61.36 marks. The Chief Executive Officer, Janpad Panchayat Sheopur, appointed other candidates with lesser marks on 4.11.2007, ignoring the petitioner’s candidature. Being aggrieved, she challenged the order dated 4.11.2007 by filing an appeal before Collector Sheopur, which was the subject matter of Appeal No. 3/2008-09. The appeal suffered dismissal by the order of Collector dated 13.7.2010. It was held that the petitioner has not produced any document to show that she belong to the backward class. The revision filed against the order of Collector before Commissioner, Chambal Division, Morena, was also dismissed vide order dated 14.5.2012.

[3]. The petitioner approached this court by filing W.P. No.4482 of

2012(s), challenging the order dated 13.07.2010 passed by Collector and the order dated 14.05.2012 passed by Commissioner. The writ petition was disposed of by this Court vide order dated 23.3.2018. The order passed by Collector as well as Commissioner were set aside. The Collector was directed to take a fresh decision after inquiring into the caste of the petitioner and after affording opportunity of hearing to the petitioner.

[4]. Upon remand, the matter was re-examined. It was found that even though the petitioner has not substantiated her claim for appointment under backward class category, however, based upon the marks secured by her, she is entitled to get the appointment under unreserved category. The Chief Executive Officer, Janpad Panchayat Sheopur, was therefore directed to appoint the petitioner on the post in question.
